上海马建荣律师解答：你公司领导和公司有两个法律关系，一为公司股东，一为公司劳动者，前者为股权关系不因是否来上班而变动，所以不存在针对股东的经济补偿办法，后者由劳动法调整，双方因平等协商，劳动者享受劳动法规定的医疗期及解除劳动合同的经济补偿。
